What Happens at Birmingham Magistrates’ Court

Birmingham Magistrates’ Court

Birmingham Magistrates’ Court sits at the Victoria Law Courts, Corporation Street, Birmingham B4 6QA. It deals with all summary offences and either-way offences. It also deals with the first appearance in cases that will be sent to the Crown Court.

First hearing

At the first hearing, you will be asked to enter a plea. If you plead not guilty, a trial date will be set. If you plead guilty, the court may sentence you at the same hearing or adjourn for a pre-sentence report.

Trial at the magistrates’ court

Trials in the magistrates’ court are heard by magistrates or a district judge rather than a jury. David presents the defence case, cross-examines prosecution witnesses, and addresses the court on sentence if convicted.

Sending to the Crown Court

If the magistrates decide a case is too serious, or if you elect Crown Court trial in an either-way case, the case will be sent to the Crown Court at Birmingham (1 Newton Street, Birmingham B4 7NA).
